1. Acceptance of Terms

By accessing or placing an order through any channel operated by Tristan Nadeau, doing business as enfant+numérique ("enfant+numérique", "we", "us", "our") — including our Shopify storefront and official social media — you agree to be bound by these Terms & Conditions in their entirety. If you do not agree, do not use our site or place an order.

2. About enfant+numérique

enfant+numérique is a design studio and sole proprietorship owned and operated by Tristan Nadeau, based in Montréal, Québec, Canada. enfant+numérique specializes in garment design, wearable art, and object design.

3. Made-to-Order Products

All items offered for sale through our website are produced on a made-to-order basis. By placing an order, you acknowledge and accept:

– Your order initiates a production process specific to your item(s). Production begins promptly upon order confirmation.

– Estimated fulfillment timelines provided at checkout are approximate. If delivery is delayed more than 30 days beyond the estimated date communicated at checkout, you have the right to cancel your order and receive a full refund, as provided under Québec's Consumer Protection Act.

– enfant+numérique reserves the right to substitute equivalent materials where original materials become unavailable, provided such substitution does not materially alter the fundamental appearance, texture, or advertised quality of the garment. Where a substitution would significantly affect the product as described, we will notify you prior to proceeding and offer the option to cancel your order for a full refund.

4. Pricing & Payment

All prices are listed in Canadian dollars (CAD) unless otherwise stated. Applicable taxes (GST/QST) are calculated at checkout based on the delivery address. Prices are subject to change at any time prior to order confirmation.

Payment is processed through Shopify's secure checkout. enfant+numérique does not store payment card information.

5. Order Confirmation & Cancellation

Orders are confirmed upon receipt of full payment and dispatch of a confirmation email. Once confirmed, orders cannot be cancelled or modified, as production begins promptly — except as provided under applicable consumer protection legislation, including the right to cancel in the event of significant delivery delay (see Section 3).

In the event enfant+numérique must cancel your order (e.g., due to unforeseen production issues), you will receive a full refund within 10 business days.

6. International Orders & Customs

For orders shipped outside Canada, you are solely responsible for all import duties, customs fees, taxes, and brokerage charges levied by your country's customs authority. These charges are outside our control and cannot be predicted.

Failure to pay customs fees may result in your order being returned or destroyed. enfant+numérique is not liable for orders lost, seized, or destroyed due to customs non-compliance.

We will provide accurate customs documentation and tracking information for all international shipments. However, final delivery confirmation is determined by the carrier and the destination country's customs authority, and enfant+numérique cannot guarantee delivery timelines or outcomes once a package has entered the customs process.

7. Intellectual Property

All designs, graphics, photographs, written content, brand marks, and product designs associated with enfant+numérique are the original work of and remain the exclusive property of Tristan Nadeau. All rights are reserved. These works are protected under applicable Canadian copyright, trademark, and intellectual property laws.

No content may be reproduced, copied, distributed, modified, or used to create derivative works — in whole or in part, commercially or non-commercially — without the prior written consent of Tristan Nadeau. Unauthorized use constitutes infringement and may result in legal action.

8. Limitation of Liability

enfant+numérique is operated as a sole proprietorship. To the fullest extent permitted by applicable law:

– Our total liability to you for any claim arising out of or related to your purchase shall not exceed the total amount you paid for the specific order giving rise to that claim.

– We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or cost of substitute goods, whether arising in contract, tort, or otherwise.

– We make no warranties — express or implied — beyond those required by applicable consumer protection legislation, including no implied warranties of merchantability or fitness for a particular purpose beyond what is described in the product listing.

Nothing in this section limits liability for death or personal injury caused by negligence, fraud, or for defective goods under applicable consumer protection legislation.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tristan Nadeau and enfant+numérique from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of our products or website; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any false or misleading information you provide in connection with an order.

10. Force Majeure

enfant+numérique shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, pandemics, supply chain disruptions, carrier failures, power outages, government actions, civil unrest, or any other event that makes performance commercially impracticable. In such cases, we will notify you as soon as practicable and work in good faith toward a resolution, including offering order cancellation and full refund where applicable.

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein. Any disputes shall be subject to the jurisdiction of the courts of Québec.

For consumers located outside Québec, applicable consumer protection legislation in your jurisdiction may grant you the right to bring proceedings before your local courts. Nothing in these Terms limits such statutory rights.

12. Language / Langue

These Terms are available in both English and French. In the event of a conflict between the two versions, the French version shall prevail for transactions with Québec consumers, as required by the Charter of the French Language.

Les présentes conditions sont disponibles en français et en anglais. En cas de conflit entre les deux versions, la version française prévaut pour les transactions avec des consommateurs québécois, conformément à la Charte de la langue française.

13. Modifications

enfant+numérique reserves the right to update or modify these Terms at any time. Changes take effect upon posting to the website. Continued use of the website after changes constitutes acceptance of the updated Terms.
